These Terms of Service ("Terms") govern your access to and use of ketonoir.shop (the "Site") and any purchase you make from it. The Site is operated by Ketonoir LLC ("KetoNoir", "we", "us", "our"), 1145 Santa Fe Drive #1297, Weatherford, TX 76087-3846, United States.

By browsing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who may use the Site

You must be at least 18 years old to purchase from this Site. By ordering, you confirm that you are 18 or older and that the information you provide is accurate and complete. We may refuse or cancel any order at our discretion, including where we suspect fraud, an unauthorized transaction, a pricing error, or a violation of these Terms.

2. Products, supplements, and health information

KetoNoir sells nutritional supplements, food preparation equipment, and apparel.

These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease.

Nothing on this Site, in our product descriptions, or in any KetoNoir content is medical advice, and none of it is a substitute for care from a qualified healthcare professional. Consult your physician before starting any supplement, ketogenic protocol, or change to your diet, and particularly if you are pregnant or nursing, under 18, taking medication, or managing a medical condition such as diabetes, kidney disease, or a cardiovascular condition. Individual results vary. Do not disregard or delay seeking professional medical advice because of something you read here.

If you experience an adverse reaction to any product, stop using it and seek medical attention.

3. Product information and pricing

We work to describe products accurately, but we do not warrant that descriptions, images, ingredient listings, or other content are error free, complete, or current. Product packaging and formulations may change, so the label on the product you receive controls. Please read it before use.

Prices are in US dollars and may change without notice. We reserve the right to correct pricing or availability errors, including after an order is placed, and to cancel and refund an affected order.

4. Orders and payment

Your order is an offer to buy. We accept it when we send confirmation or ship the items. Payment is processed by our payment providers through Shopify, and you agree to their handling of your payment details. We do not store full payment card numbers.

5. Shipping and delivery

We currently ship within the United States only. Orders ship from Weatherford, Texas by UPS Ground. We hand off to the carrier within 1 to 2 business days of receiving your order, and most US deliveries arrive within 3 to 5 business days after shipment. Delivery estimates are estimates, not guarantees, and we are not responsible for carrier delays.

Risk of loss passes to you on delivery to the carrier. Our Shipping Policy is incorporated into these Terms.

6. Returns and refunds

Our Refund Policy is incorporated into these Terms. In summary:

Opened or used consumable products cannot be returned, for health and safety reasons. Unopened, sealed consumables may be returned within 30 days of delivery for a refund minus shipping. Unworn, unwashed apparel with tags attached, and unused undamaged gear in original packaging, may be returned within 30 days of delivery on the same basis. You pay return shipping unless the item arrived damaged, defective, or incorrect.

Contact customer.support@ketonoir.shop for a return authorization before sending anything back. If your order arrived damaged, defective, or wrong, contact us within 7 days of delivery with photos and your order number and we will replace or refund it, your choice, and cover return shipping.

7. Apparel made to order

Some apparel is produced on demand by a third party print provider. Slight variation in placement, color, and sizing is normal and is not a defect.

8. Affiliate links and third party sites

The Site may contain affiliate links. Where it does, we may earn a commission on a qualifying purchase at no additional cost to you. Third party products and sites are not operated by us. We do not control and are not responsible for their content, products, terms, or privacy practices, and a link is not an endorsement.

9. Intellectual property

The Site and its content, including the KetoNoir name, logo, wordmark, text, images, and design, are owned by Ketonoir LLC or its licensors and are protected by intellectual property laws. You may not copy, reproduce, republish, sell, or create derivative works from any part of it without our prior written permission. Third party marks are the property of their owners.

10. Acceptable use

You agree not to use the Site to break any law, infringe anyone's rights, transmit malicious code, scrape or harvest data by automated means without permission, interfere with the Site's operation or security, or misrepresent your identity. We may suspend or terminate access for any violation.

11. User content

If you submit a review, comment, image, or other content, you grant us a non exclusive, royalty free, worldwide license to use, reproduce, and display it in connection with our business. You are responsible for what you submit and confirm you have the right to submit it. We may remove content at our discretion.

12. Disclaimer of warranties

The Site and everything on it are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non infringement, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, secure, or error free.

13. Limitation of liability

To the fullest extent permitted by law, Ketonoir LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Site or any product purchased from it. Our total liability for any claim will not exceed the amount you paid for the product giving rise to that claim.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.

14. Indemnification

You agree to indemnify and hold harmless Ketonoir LLC from any claim, loss, liability, or expense, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Site.

15. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. You agree that any dispute will be brought exclusively in the state or federal courts located in Parker County, Texas, and you consent to their jurisdiction.

16. Changes to these Terms

We may update these Terms at any time. The version posted on the Site is the version that applies, and the "Last updated" date above shows when it last changed. Continuing to use the Site after a change means you accept the revised Terms.

17. Severability and entire agreement

If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, are the entire agreement between you and us regarding the Site.
